1. Can a foreigner own a land in Thailand legally?
Being a foreigner you can own a land in your Thai limited company’s name or simply as a marital property. You can even buy land in your Thai spouse’s name and ask her to give you usufruct on the land. However, usufruct will give you total control of the property except for its ownership.
2. How can you get construction permission?
It can be obtained at the Local Administration Organization or the Municipal Office, wherein the land is situated. Typically, structure plans submitted should be certified by the engineer.
3. What if your land is secretly transferred?
Remember, any unregistered action related to land will not be recognized under the Thai property law, so you need not worry much.
4. How is land measured in Thailand?
It is measured in Wah, Ngan and Rai.
- 1 Acer = 2.5 Rai
- 1 Rai = 4 Ngan (or 1600 Sq.m.)
- 1 Ngan = 100 Wah (or 400 Sq.m.)
- 1 Wah = 4 Sq.m.
- 1 Hectare = 6.25 Rai
5. Can a foreigner buy a land or any other property in Thailand in his absence?
Yes. Whether or not you are a foreigner you may buy a land even without being present during the time of property registration at the Land Department. Well, this is possible with the help of a lawyer. What you will have to do is appoint one of our lawyers and give them the power of attorney to work on your behalf.
However, if you have a Thai wife, she will require to state in a written agreement that the land purchased is hers as her personal affair even before marriage. The process can be done by signing a declaration abroad as well as a demand for the certification in your country at the Consulate of Thailand.
6. Can a foreigner rent out a property in Thailand?
Yes, of course. In fact, there are a few banks in Thailand that allow opening an account in order to collect rents.
