The two forms of POAs:
- General Power of Attorney (GPA)
- Special Power of Attorney (SPA)
As the names suggest, a General Power of Attorney (GPA) gives way for broader and more durable authority, while the Special Power of Attorney (SPA) is not as flexible and is limited in scope and duration.
Both your and the lawyer must be legally capacitated, and be able to either give or execute the powers stated in the POA, which must also conform with all other formal and substantial legal requirements for it to be considered valid and enforceable, including the notarization of the POA document after it has been signed by both parties.
